Terms and Conditions of Use

1. General Provisions

These Terms and Conditions of Use (hereinafter "Terms") govern access to and use of the "Design Karma" platform (hereinafter "Platform"), owned by Figmaistor, accessible at karma.figmaistor.bg.

By registering and using the Platform, you agree to comply with these Terms, including the Non-Disclosure Agreement (NDA), which forms an integral part thereof.

2. Non-Disclosure Agreement (NDA)

2.1. Confidentiality of Designs

All designs shared on the Platform by users are considered strictly confidential information. As a user of the Platform, you agree to:

  • NOT distribute, copy, transmit or share in any way designs published on the Platform outside of it
  • NOT take screenshots, recordings or other forms of documenting designs
  • NOT use information from designs for personal or commercial purposes
  • NOT show designs to third parties who do not have access to the Platform
  • Use designs SOLELY for the purpose of reviewing and providing feedback within the Platform

2.2. Penalties for Violation

In case of violation of the confidentiality obligations under clause 2.1, the violator faces the following consequences:

  • Immediate termination of access - Your account will be permanently blocked without warning
  • Financial penalties - Payment of compensation of BGN 5,000 (five thousand leva) for each separate violation
  • Legal consequences - Figmaistor and/or the design author reserve the right to take civil and criminal legal action for:
    • Copyright infringement (Art. 94-100 of the Copyright and Related Rights Act)
    • Non-performance of contractual obligations
    • Property and non-property damages caused
    • Unfair competition
  • Compensation for damages - Payment of all damages suffered by the authors, including lost profits and legal fees

WARNING: Violations are documented and reported to the competent authorities. Under Bulgarian law, copyright infringement may be subject to criminal prosecution with fines and imprisonment.

3. Copyright and Ownership

3.1. Authors' Rights

All designs published on the Platform remain the exclusive property of their authors. Authors retain their full copyright under the Copyright and Related Rights Act of the Republic of Bulgaria.

3.2. Limited Platform License

By uploading a design to the Platform, the author grants Figmaistor a limited, non-exclusive, royalty-free license to:

  • Display the design to registered Platform users
  • Technical storage and processing of the design
  • Create thumbnails for visualization purposes

The Platform does NOT receive rights to distribute, sell, modify or use designs beyond the described purposes.

3.3. Download Prohibition

Users may NOT download designs from the Platform. Access is restricted solely to viewing and commenting within the Platform's web interface.

4. User Obligations

4.1. Registration and Account

  • Users agree to provide accurate and current information upon registration
  • Each user is responsible for maintaining the security of their account and password
  • Sharing an account with third parties is prohibited
  • The user is responsible for all actions performed through their account

4.2. Conduct and Ethics

  • Offensive, obscene or inappropriate comments are prohibited
  • Feedback must be constructive and professional
  • Using the Platform for spam, advertising or other commercial purposes without consent is prohibited
  • Publishing designs that infringe third-party rights or contain illegal content is prohibited

4.3. Karma System

The Platform uses a karma points system to regulate activity. Users agree to:

  • Not abuse the karma system through fake accounts or coordinated actions
  • Provide quality feedback, not comment solely for the purpose of earning points
  • Accept moderator decisions regarding karma point allocation

5. Personal Data Protection (GDPR)

5.1. Data Collected

Figmaistor collects and processes the following personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act:

  • Name and email address (upon registration)
  • Username and profile information
  • IP address and visit data (for security and analytics)
  • Uploaded designs and comments
  • Activity history and karma points

5.2. Purpose of Processing

Personal data is processed for the following purposes:

  • Providing Platform services
  • Ensuring security and preventing abuse
  • Communication with users
  • Improving Platform functionality
  • Compliance with legal obligations

5.3. User Rights

Under GDPR, users have the right to:

  • Access - receive a copy of your personal data
  • Rectification - request correction of inaccurate data
  • Erasure - request deletion of your data ("right to be forgotten")
  • Restriction - request restriction of processing
  • Portability - receive your data in a structured format
  • Objection - object to the processing of your data

5.5. Cookies

The Platform uses cookies to ensure functionality and improve the user experience. We use necessary cookies for authentication and session management. You can manage cookies through your browser settings.

5.4. Data Retention

Personal data is retained while the account is active. Upon account deletion, data is anonymized or deleted within 30 days, unless the law requires a longer retention period.

6. Platform Liability

6.1. Limitation of Liability

Figmaistor makes efforts to maintain a safe and functioning Platform, but is NOT liable for:

  • Quality of feedback - The Platform does not guarantee the quality, accuracy or usefulness of user comments and suggestions
  • Disputes between users - The Platform is not responsible for conflicts, disagreements or disputes between users
  • Security incidents - Although we apply industry security standards, we cannot guarantee absolute protection against hacking or unauthorized access
  • Technical issues - Service interruptions, data loss or other technical issues arising from circumstances beyond our control
  • User actions - Illegal, unethical or harmful actions of users
  • Third-party content - Content, links or references to external websites

6.2. "As Is" Provision

The Platform is provided "as is" without warranties of any kind — express or implied. Users use the Platform at their own risk.

6.3. Moderation

Figmaistor reserves the right, but is not obligated, to moderate, edit or remove content that violates these Terms. Moderators act at their discretion and their decisions are final.

7. Termination of Access

7.1. Voluntary Termination

Users may at any time terminate their use of the Platform by deleting their account from the profile settings.

7.2. Termination by Platform

Figmaistor reserves the right to suspend, restrict or terminate access to the Platform in case of:

  • Violation of these Terms and Conditions
  • Violation of the Non-Disclosure Agreement (NDA)
  • Abuse of the karma system
  • Unethical behavior or harassment of other users
  • Publishing illegal content
  • Attempts to hack or compromise Platform security

For serious violations, termination may be immediate and without warning.

8. Changes to Terms

Figmaistor reserves the right to update these Terms at any time. For significant changes, users will be notified via email and/or through a Platform notice. Continued use of the Platform after changes take effect constitutes acceptance of the new terms.

We recommend regularly reviewing these Terms.

9. Applicable Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Republic of Bulgaria.

All disputes arising from or related to these Terms or the use of the Platform shall be resolved by the competent Bulgarian courts.
